On November 12, 2020, pursuant to s. 28.3(1)(b) of the Homeowner Protection Act (the “Act”), Godin Construction Ltd. (“GCL”) and Christopher Douglas Godin (“Godin”) were issued a monetary penalty, jointly and severely, in the single amount of $7,350.00. This Monetary Penalty was issued for the following reasons:
- GCL and Godin, contrary to section 14(1) of the Act, conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, July 30, 2019, and February 2020;
- On July 22, 2020, BCH issued Compliance Order 20-0020 (the “CO”) to GCL and Godin directing that GCL and Godin immediately cease carrying on the business of a Licensed Residential Builder (“LRB”), cease all signage, marketing, advertising and other publications and media that imply, suggest or holdout in any manner that either Godin or GCL is a LRB, and immediately apply for and become a LRB pursuant to section 14(1) of the Act;
- GCL and Godin were ordered to comply with the CO by August 28, 2020; and
- GCL and Godin failed to comply with the orders contained in the CO by the requested compliance date.
