Arjan Holdings Ltd. (“AHL”) and Salinder Singh Bhatti (“Bhatti”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, February 28, 2019, and August 28, 2019, regarding a new home in Surrey, BC (the “New Home”). On August 28, 2019, BCH issued Compliance Order 19-0011 to AHL and Bhatti directing that AHL and Bhatti:
• immediately cease carrying on the business of a residential builder as defined in the Act, and cease construction activities on the New Home until such time as AHL is issued a Residential Builder Licence by BCH pursuant to section 14 of the Act;
• immediately apply for and become a Licensed Residential Builder (“LRB”) pursuant to section 14(1) of the Act; and
• prior to resuming construction on the New Home, provide BCH Compliance Department with proof that the New Home is being built by a LRB pursuant to section 14(1) of the Act.
AHL and Bhatti were directed to comply with Compliance Order 19-0011 by October 4, 2019.
